What is Repossession?
This is a legal process through which your lender can get a court order to give them possession of your home, so that they can sell it to pay off what you owe them. As part of this process you will no longer have a right to live in your home and you will be evicted.
This will only happen if the court decision is an Outright Possession Order. The court may decide that a Suspended Possession Order is more appropriate. In this case you must agree to make a specific payment each month, but if you fail to make the payments you will be evicted possibly with very little notice.
A Time Order is another alternative that the court may give you if you have a secured loan or second mortgage on your home. This will enable your payments to be reduced by either a change of interest rate on your mortgage or by making the term longer.
The final option available to the court is a Money Judgment. This gives your lender the right to recover the whole of the outstanding mortgage amount and not just the payments you have failed to make.
